Please note that the STGA Policy on  Owner Driver-Guides, Hirer Driver-Guides and PCV Drivers (not guides) is as follows:

·         Owner Driver-Guide: is a member who usually guides with their own car or is listed by name on the insurance certificate and has a share in the vehicle (not just the guide who appears on the registration document).

·         Hirer Driver-Guide: is a member who guides in hired cars.

·         PCV Driver: a member who holds a Passenger Carrying Vehicle licence but does not guide in vehicles larger than for 9 people (driver plus 8 passengers). The STGA does not support coach-driver-guiding because the use of a hand-held microphone is prohibited by statute and it is Counsel’s Opinion that, although a driver of a vehicle designed to carry more than 8 passengers may speak into a fixed or “hands-free” microphone, it would remain possible for there to be a conviction in terms of s 3 of the Road Traffic Act 1988 for careless or inconsiderate driving if, for example, the commentary undertaken by the driver of the coach resulted in a distraction or lapse of concentration which caused an accident to occur.

It is a legal requirement under Scottish law that these guides have an appropriate licence and insurance to cover driver guiding. Driver Guide members of the STGA have sole responsibility for ensuring that they obtain and retain in force all appropriate forms of licence and insurance to cover their activities as owner or hirer driver-guides and they alone must ensure that they comply with their statutory obligations. The STGA is not responsible for doing so and will not be liable for any loss arising from any such failure on the part of its members.
